Section 2The Parties

This agreement is between Ksenia Pro Photography, LLC, hereinafter referred to as the "Photographer", operating in the State of Maryland, and the subject(s) (if the subject is over 18 years old) or the legal guardians of minors contracting the Photographer for portrait photography, hereinafter referred to as the "Client", collectively referred to as the "Parties", for the portrait session detailed above.

The Client is the person who books and pays for the session, and who is responsible for every member of their party, including minors.

References to the Photographer in this agreement are references to the company. The Photographer performs the session through its personnel, and the session is photographed by the photographer the studio assigns to it.

Section 3Coverage and Fees

The Mini Session Special includes:

  • 20-minute outdoor portrait session

  • 14 days of private online gallery with proofs, for preview and order only
  • 5 retouched downloadable digital photographs
  • High-resolution JPEG files, delivered electronically

Sales tax. Maryland sales tax is charged on the session fee and on additional digital images. Separately charged service items — additional participants, expedited delivery and gallery reactivation — are not taxed.

The total service fee is as set out in the Client's quote and invoice.

Section 4Delivery and Gallery Access

Your images

Client will receive online access to digital proofs within 7 days of the portrait session. Photographer retains the right to edit the photographs and to omit any image.

Client will have the opportunity to select their favorite images and place the order. Final retouched downloadable high-resolution images will be delivered within 7 days of the Client submitting their selections. Additional prints or digital photographs are available for purchase à la carte.

Client understands that the digital images will be made available electronically over the internet, and that it is the Client's sole responsibility to access and download these images.

Gallery access and reactivation

The Client's gallery is active for selection and ordering for fourteen (14) days from the session date (the "Access Period"). After expiration, the gallery is deactivated.

The first reactivation is free and grants fourteen (14) additional days of access. Each subsequent reactivation is billed at a flat fee of $49 and grants thirty (30) additional days of access; this fee applies each time reactivation is needed thereafter.

The Photographer keeps a copy of the Client's images for twelve (12) months from the session date. After that period the Photographer is not responsible for storing, backing up or retrieving the images, and they may be deleted.

Downloading and backing up your images is the Client's responsibility. Please save your files somewhere safe as soon as they are delivered, and do not rely on the gallery or on the Photographer's storage as your only copy.

Expedited delivery (optional)

Expedited delivery may be added at the time of booking or after the session, subject to Photographer availability. It is not included in standard services and requires an additional flat fee of $150.

Under expedited delivery, the online proof gallery is delivered within 48 hours after the session, and final edited images are delivered within 72 hours after the Client submits their final image selections.

The Client is responsible for notifying the Photographer by direct text message or email once their final image selections have been submitted. The Photographer is not responsible for delays caused by late selection submissions or delayed communication from the Client.

Section 5Payment and Confirmation

The Client reserves the time and date of the photo session by accepting this agreement and submitting payment in full. Both steps are completed online at the time of booking.

No date is reserved until this agreement is accepted and payment has cleared. The session is confirmed automatically at that point; a time slot remains available to other clients until it is paid for. Payment is accepted online via major credit or debit cards.

Section 6Cancellation, Rescheduling and Weather

If the Client cancels

The Client understands that by entering into this agreement, the Photographer is foregoing other photographic work. In the event of a cancellation by the Client, payment is refunded as follows:

7 or more days before the session

Full refund, less a 5% processing and administration fee

48 hours to 7 days before the session

50% refund, less a 5% processing and administration fee

Less than 48 hours before the session

Non-refundable

The 5% processing and administration fee covers the non-recoverable cost charged to the Photographer by its payment provider, together with the administrative cost of processing the cancellation and re-releasing the time slot. It is applied only to cancellations initiated by the Client. It is not applied where the Photographer cancels, or where the session is cancelled on account of weather.

No rescheduling

Fall Mini Sessions take place on a single assigned date and cannot be rescheduled. Slots are not transferable to another date, and payments are not transferable to another mini session date, except as set out below.

Weather and the raincheck date

Fall Mini Sessions are held outdoors. If severe or unsafe weather makes it impossible to hold sessions on Saturday, October 17, 2026, all sessions move to the raincheck date, Sunday, October 25, 2026, at the Client's same time slot, at no additional cost. The Photographer determines whether conditions make the session impossible.

If the Client is unable to attend the raincheck date, the Client may choose either:

  1. a full refund, with no processing fee or any other amount deducted; or
  2. credit toward any other session type offered by the studio, equal to the full amount paid. This credit expires twelve (12) months from the original session date.

If the Photographer must cancel for any reason — including illness, emergency or force majeure — and the session cannot be held on the raincheck date, every affected Client receives a full refund with nothing deducted.

Cooperation and no-shows

The Photographer is not responsible if the Client and/or key individuals fail to appear or to cooperate during the portrait session, or for missed images due to details not disclosed to the Photographer.

If the Client fails to appear at their scheduled session, payment is non-refundable and the session is not rescheduled. The Client is welcome to book a future mini session date at the price then in effect.

No reshoots will be provided and no payment refunded on the basis of dissatisfaction with makeup, hairstyling or similar styling decisions once the session has been completed.

Section 7Outdoor Location, Safety and Assumption of Risk

Fall Mini Sessions take place outdoors at Black Hill Regional Park, a public park. The Client acknowledges that the location consists of natural and uneven terrain — which may include grass, exposed roots, slopes, gravel paths, wooded areas and proximity to open water — and that conditions are affected by weather.

The Client attends voluntarily and assumes the ordinary risks of being outdoors at the location, including slips, trips and falls, insect bites, allergens and exposure to weather.

The Client, and any accompanying adults, remain responsible at all times for the supervision and safety of all minors and every other member of their party. Posing direction given by the Photographer is creative direction only. It is not supervision, and it does not transfer responsibility for a child's safety to the Photographer. The Client is responsible for judging whether any direction is safe and appropriate for themselves and their party, and should decline anything they are not comfortable with.

The Client is responsible for their own personal property at the location. The Photographer is not responsible for loss of or damage to personal belongings.

Except to the extent that liability cannot lawfully be limited or excluded — including for gross negligence, recklessness or intentional misconduct — the Photographer is not liable for injury, illness, or loss of or damage to property sustained by the Client or any member of their party before, during or after the session.

The Client will notify the Photographer in advance of any medical condition, mobility limitation, allergy or pregnancy that may affect participation in the session.

Section 8Retouching and Digital Files

Standard retouching includes skin retouching, stray hair removal where possible, slimming, colour toning, highlight and shadow enhancement, and more.

Revision requests are not included with mini session images. Mini sessions are a reduced-scope offering; images are delivered as edited by the Photographer, in the Photographer's editing style. The Photographer does not use digital backgrounds or AI-generated elements in image editing or final retouching.

Additional retouched digital images may be purchased through the online gallery at $49 + tax per image.

While the Photographer always aims to achieve the best possible result, the final outcome may be influenced by the Client's choice of wardrobe, grooming and level of preparation. These remain the Client's responsibility and are an important part of the overall result.

Section 9Image Rights and Usage

The Client's usage

The Client is obtaining prints and digital images for personal use only, and shall not resell said prints. The full-resolution digital files provided to the Client may be printed and reprinted at any printing lab without further consent from the Photographer.

Images may be published online on social media, personal sites and blogs. Photography credit is appreciated.

Copyright

All images are copyrighted to and remain the property of Ksenia Pro Photography, LLC.

Model release

The Client grants to the Photographer and its legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs of the Client, the Client's child or children, or in which the Client may be included, for editorial, trade, advertising, promotion and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases the Photographer and its legal representatives and assigns from all claims and liability relating to said photographs.

The Client may request in writing that images from their session not be used for marketing purposes. Such a request will be honored from the date it is received.

Exhibition

The Client grants the Photographer permission to display selected images resulting from this assignment as an example of the Photographer's work and for entry into photographic competitions, and releases all claims to profits that may arise from use of the images.

Section 10Limit of Liability

The Photographer takes the utmost care with respect to the exposure, retouching and transportation of digital captures, proofs and prints. However, in the unlikely event that all originals are lost, stolen, damaged or destroyed within or beyond the Photographer's control, the Photographer's liability is limited to the refund of all payments received, or a reshoot may be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total, based on the percentage of originals lost or damaged.

In the unlikely event that the assigned photographer is injured or becomes too ill to attend the portrait session, the Photographer will make every effort to hold the session on the raincheck date or to assign a replacement photographer. If neither is possible, responsibility and liability are limited to the return of all payments received, with nothing deducted.

The Client acknowledges that they are familiar with the Photographer's style and agrees that final images will reflect the Photographer's artistic judgment.

Section 11General

Changes to this agreement

There may be additional charges if changes are made to this agreement. The Client may not decrease the period of the Photographer's service on the session date. Added expenses resulting from any change will be added to the final balance and paid in full by the Client prior to delivery of the online proof gallery.

If the period of the Photographer's service is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the Parties, the Photographer shall still receive the total fees outlined above.

Entire agreement

This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior agreements between the Parties. The only way to add to or change this agreement is to do so in writing, signed by all Parties. If the Parties waive one provision of this agreement, it does not mean that any other provision is also waived.

This constitutes an order for one Mini Portrait session with Ksenia Pro Photography, LLC.
